By clicking the "I AGREE" button, You (referred in this document as a "Member" or "You") agree to be irrevocably bound by the following terms and conditions (the "Terms of Use," "Agreement" or the "Document") on the website Checkhimout.com, a proprietary domain name and trademark of Doublesquad Inc (hereinafter referred to as "Checkhimout.com" or “the Website” or “the Service”).

CHECKHIMOUT.COM RESERVES THE RIGHT TO MAKE CHANGES TO THESE TERMS OF USE AT ANY TIME. YOUR CONTINUED USE OF THE SERVICE CONSTITUTES YOUR ACCEPTANCE OF SUCH CHANGES. ACCORDINGLY, YOU SHOULD INSPECT THESE TERMS FROM TIME TO TIME FOR CHANGES.

A – Checkhimout.com’s Representations and Warranties

High–End Social Platform - Checkhimout.com is an elegant online dating platform where single adults may interact in a secure and confidential environment. Members of the Service are expected to be courteous and respectful; no lewd or sexual explicit content is allowed on the Website.

Control Policy – Checkhimout.com will monitor information posted by Members to the Website in order to provide You with high-quality encounters. Checkhimout.com will screen all Members profiles, including their description and profile pictures, in order to filter inappropriate content. The Website will not, however, research the background of its Members in any way or attempt to verify the accuracy of their posted information.

Checkhimout.com may make no representations or warranties as to the conduct of Members on the Website. However, Checkhimout.com has elaborated a clear Code of Conduct, as elaborated in section B, that each Member must abide by in the interest of maintaining the quality of exchanges on the Website.

In order to enforce its Code of Conduct, Checkhimout.com will implement a three point policy:

  • Screening of profile content before it is posted on the Service.
  • Screening of posted or exchanged content based on reporting by other Members (flagging or reporting) or random verification by Website moderators.
  • Sanctioning unacceptable behaviors as determined by Checkhimout.com in its sole discretion. Possible sanctions include, but are not limited to, simple warnings, profile suspension or exclusion from the Website.

Checkhimout.com reserves the right, but has no obligation, to monitor all interactions between You and other users of the Service and to take any necessary action to restrict or sanction the publication of any material that we or any user of our Service may consider to be obscene, lewd, lascivious, filthy, violent, harassing or otherwise objectionable. While private and chat messages exchanged between You and other Members of the Service that are not readily accessible to the general public may be reviewed by Checkhimout.com for compliance with the Code of Conduct or any of these Terms of Use, they will be treated as private to the extent made possible by applicable law.

Confidentiality - Checkhimout.com guarantees that it will do its best to secure the highest level of confidentiality and security of it Members’ personal information. Our full Privacy Policy is incorporated herein for reference under Section D.

No–Fake–Members Policy - Checkhimout.com guaranties that it will not activate fake member profiles in any attempt to improve website activity.

Permanent Access - Checkhimout.com promises its Members that its Service will be available without interruption 24/7 throughout the year, except for punctual maintenance operations. Checkhimout.com may not be found responsible if You cannot access the due to the failure of the Internet provider, or to the equipment or obsolete navigation software making the connection slow or impossible. Notwithstanding the foregoing, in certain circumstances, we cannot be found liable as more fully explained under Section E below.

B – Checkhimout.com Membership

1. Registration Conditions

To become a Member of the Service, You must be a legal adult according to the legislation of the country or state in which You reside. You will be prompted to acknowledge in the registration process that You are of legal age in your country or state of residence in order to start using Checkhimout.com. You must also declare not to be mentally unable and/or under guardianship.

You may not subscribe to Checkhimout.com if You have been convicted by a court of law for sexual assault, sexual attacks, pedophilia or any other sexually related felonies or crimes under the laws of the country in which You reside, as well as under any the laws of any other State in which You may have been found liable for such felonies or crimes.

2. How to Subscribe

In order to use the Service, You must create a Checkhimout.com account. You will be asked to create a username and a password, and provide personal information which will serve to retrieve any forgotten login or password information. This username and password are only created once and will be required each time You wish to access the Service.

When You first access the Service, You will be asked to provide complementary personal information concerning Your online dating profile and Your membership preferences, including text, pictures and other information or data. Our moderators will then review and eventually validate your account. During the validation period, You will be allowed to view others Members' profiles, but not to communicate with other Members on the site. Once your account is validated, your profile will be posted for other Members to view and You will be given the possibility of exchanging with other Members via Checkhimout.com’s communications features.

3. Membership terms

a. Free Membership - Becoming a Member on Checkhimout.com is free for everyone. The membership allows You to access public areas of the Service and use unpaid services such as search, or browsing Member profiles.

Memberships are not in any way transferrable from one Member to another Member.

b. Paid Services - For male subscribers on, communicating with female Members requires a purchase of credits as more fully detailed in the Terms of Sale. All funds are quoted in the currency in which they are displayed or, by default, in United States dollars. Prices are displayed without taxes. Checkhimout.com reserves the right to change its pricing policy or the method or manner in which it charges for its Service at any time at its sole discretion without further notice. Once Checkhimout.com has confirmed receipt of Your payment, Your account will be credited with the number of credits purchased. If we receive payment for an incorrect amount or in a currency other than the one displayed, we reserve the right to credit Your account with a pro–rated number of credits based on the funds received, converted to the specified currency at a reasonable market exchange rate at the time of processing. Purchased credits will be automatically deducted as You use the Service. Paying members can view their remaining number of credits at any time in the dedicated section at the top of the website. A Member who has no remaining credits or whose VIP membership has lapsed will remain a Member, but will not be able to access "paid features" until credits or additional VIP time are purchased.

If Your usage of the Service is terminated because of a breach of this Agreement or for any other reason, any unused balance will be immediately forfeited. Checkhimout.com reserves the right to clear any unused credits without refund 180 days after Your last login or 365 days after the date of purchase, whichever arrives first.

We may change the fees and charges in effect for using the Service, or add new fees or charges, by posting new fees and changes on the site and in the Terms of Sale as laid out in section C.

Individual Members are solely responsible for any fees or charges incurred to access the Service through an Internet access provider or other third party service, including but not limited to telephone or cable charges.

c. Refund Policy - The purchase of initial and recurring credits is non–refundable.

4. Member Code of Conduct

Checkhimout.com strives to ensure that its Members have a pleasant and safe experience on the Service. In this light, the site’s moderators screen profiles at the time of registration to ensure that no offensive content is displayed on the Service. As more fully explained above, Checkhimout.com’s moderators can also be asked to review and remove any offensive comments or interactions in the Service.

However, because the online dating experience depends to a large extent on the behavior of each individual Member, Checkhimout.com also enforces the following code of conduct.

Code of Conduct By subscribing to Checkhimout.com, each Member pledges that, at all times during the use of the Service, he or she will:

  • Guarantee that the information he or she provides to Checkhimout.com are true and accurate (for confidentiality reasons, You are not required to reveal Your real identity to other Members and may choose to create a pseudonymous username, but Your personal description and location must be truthful).
  • Be polite, courteous and civilized when engaging in conversation with other Members of the Service and Checkhimout.com’s customer representatives.
  • Respect other Members' privacy by not exploiting, using or divulging their personal information in any way on the Service or anywhere else, online and offline.
  • Update any information of his or her personal space so as to reflect a true and accurate image of his or her profile.
  • Report any evidence of behavior contrary to the present code to the Checkhimout.com support team.
  • Generally abide by all conditions stated in these Terms of Use.

Unacceptable Conduct: Each Member warrants that he or she will not engage in any of the prohibited following acts, or behaviors, at any time:

  • 1. Use any information obtained on the Service for any unauthorized or unlawful purpose.
  • 2. Impersonate any other person or entity, or post pictures and/or any information, which does not correspond to Your true identity.
  • 3. Post on the Service, via Your personal space, any content (texts, images, information, software…) of others protected by any intellectual property rights, without having obtained the prior consent of the owners.
  • 4. Write, utter, state or publish libelous, defamatory or slanderous statements on the Service and/or offline regarding any Member, or personal information of a Member.
  • 5. "Stalk," harass or promote the harassment of any other Member of the Service.
  • 6. Upload, publish on the Service any shocking, offensive or sexually charged pictures or content in Your profile or anywhere on the Service.
  • 7. Post pictures and/or information of or concerning minors on the Service.
  • 8. Write, utter, state or publish any statement on the Service and/or offline promoting in any way any form of racism, denial of the Holocaust, discrimination, xenophobia, pedophilia or any other type of physical and/or verbal violence of any kind against any group, or endangering public order.
  • 9. Use abusive, obscene, profane, offensive, sexist, threatening, harassing, racially offensive, or otherwise behave inappropriately when communicating with other Members or with Checkhimout.com’s customer service representatives.
  • 10. Post or submit any content that: (a) encourages or otherwise depicts or glamorizes drug use (including alcohol and cigarettes), (b) makes use of offensive language or images or is otherwise patently offensive, (c) promotes an illegal or unauthorized copy of another person' s copyrighted work, (d) characterizes violence as acceptable, glamorous or desirable, (e) contains any illegal material or any material that infringes or violates another party' s rights (including without limitation intellectual property rights and rights of privacy and publicity), (f) provides instructional information about illegal activities such as making or buying illegal weapons, violating someone' s privacy, or providing or creating computer viruses, (g) solicits passwords or personal identifying information for commercial or unlawful purposes from other users, (h) provides or promotes inaccurate, misleading or false information.
  • 11. Use the Service for professional or commercial purposes (including but not limited to canvassing, soliciting or prostitution) or for any non-private purposes.
  • 12. Use the Service in connection with the distribution of unsolicited commercial email ("Spam") or advertisements.
  • 13. Collect or store any information about any other Members other than in the course of the permitted use of our Service
  • 14. Communicate to other Members or acquaintances Your personal login information for access to the Service (username and password). Checkhimout.com cannot be held responsible for any malevolent, fraudulent or abusive use of the concerned account and the Member will be the only one to bear the consequences.
  • 15. Transmit, distribute, post or submit any private personal information or data, including without limitation, photographs of others, personal contact information or credit, debit, calling card or account numbers.
  • 16. Divulge or transmit Your personal information enabling another Member to contact You through means other than Checkhimout.com’s communication tools. Similarly retrieve or use a Member’s personal information to contact them in any way other than through Checkhimout. com’s communication tools.
  • 17. Attempt to harm or disrupt the Service in any way and by any means including, without limitation, through the use of viruses, cancel bots, Trojan horses, harmful code, flood pings, denial of service attacks, packet or IP spoofing, forged routing or electronic mail address information or similar methods or technology, including methods that in any way reproduces or circumvents the navigational structure or presentation of the Service or its contents.
  • 18. Extract, use, post, distribute, duplicate and/or reproduce in any way any elements of intellectual property belonging to Checkhimout.com (including its trademarks, image, logos, or any other intellectual property rights) for any reasons, whether commercial or not, legal or not.

Take Reasonable Precautions - Each Member agrees to take reasonable precautions in all interactions with other Members of the Service, particularly if he or she decides to meet offline or in person. Each Member should not provide his or her financial information (for example, credit card or bank account information) to other Members of the Service.

5. Suspension, Discontinuance, Termination and Eviction

  • Termination of a Member' s account by Member: A Member may request the termination of his account at any time by sending an email at unsubscribe@checkhimout.com or clicking the ‘unsubscribe’ link in their personal account settings on the Service.. Checkhimout.com will remove the posting of the Member' s personal information from the Website within 30 days after the receipt of the e-mail. There will be no reimbursement for unused credits on the Member' s account on the day of termination of said account.
  • Voluntary suspension of Service: A Member may at any time request the suspension of his Checkhimout.com account via the ‘disable account’ link in their personal account settings on the Service. The suspended profile will thus be removed from the public online space and as such will not be accessible by other Members. The profile and corresponding personal information will be stored by Checkhimout.com for an indefinite period of time and the Member may at any time reactivate the Service without the need to create a new profile.
  • Eviction of a Member by Checkhimout.com: Checkhimout.com can temporarily or permanently stop providing access of its Service to a Member at any time and without notice, if the Member violates any terms and conditions of the Service, as determined at our own discretion. Checkhimout.com may, depending on the seriousness of the violation, issue a simple warning to the concerned Member with notification of the violation and a request that the Member cease the inappropriate conduct immediately, or in worst cases temporarily or permanently terminate the account of the Member without notice. Unused credits remaining on the Member' s account on the day of the eviction will be lost, and there will be no reimbursement or compensation.
  • Discontinuance: We reserve the right at any time to modify or discontinue, temporarily or permanently, any portion of our Service with or without prior notice. You agree that Checkhimout.com will not be liable to You or to any third party for any modification or discontinuance of the Service.
  • Blocking of IP Address: In order to protect the integrity of the Service, we reserve the right to block users from certain IP addresses from accessing our Site at any time and in our sole discretion.

C – Checkhimout.com Terms of Sale

Checkhimout.com offers online dating features that allow members to attract potential dates and interact with each other on the website, namely:

  • Instant chat
  • Private messages
  • Virtual gifts
  • Access to private albums
  • ‘Check me out!’ requests (male subscribers only)
  • Advertising Yourself (male subscribers only)

The use of these features is, and always will be, free for female members. Male subscribers, in order to use the online dating features described above, must purchase Checkhimout.com credits (the site’s currency) or a VIP dating membership, as further explained below.

Paying members gain access to Checkhimout.com’s website features in one of two ways: purchasing a credit pack or subscribing to a VIP membership.

a – Credit packs

Credits are Checkhimout.com’s internal currency. Subscribers purchase a certain amount of credits which are added to their online dating account and debited on a pay-per-action basis. All pack prices include tax and are susceptible to change at Checkhimout.com’s discretion.

Pack prices (updated 12/20/2012):

  • Standard pack: 250 credits for $4.99 (available on site & mobile)
  • Mobile pack: 750 credits for $9.99 (mobile only)

The value of credits:

  • Chat: only pay once per chatting session, regardless of conversation time - 15 credits at a contact’s first response to Your instant message
  • Messages: only pay for the first message of a conversation - 30 credits to send or read a first message
  • Virtual gifts: pay per item value, anywhere from 0 to 1000 credits
  • Checkout requests: first 3 daily request are free, then pay 10 credits for each additional request
  • Private albums: 5 credits to request access to a private album and 15 credits to open the album for the first time
  • Advertising Yourself: 50 credits for 1 day as recommended product, 100 credits for 3 days or 150 credits for 1 week

b – VIP membership

For a one-time fee, the VIP member obtains unlimited use of all Checkhimout.com online dating features for three months. VIP subscribers also stand out on the website with a special label and benefit from automatic preferential placement.

  • VIP pack: unlimited site usage for 3 months for $99 (site only)

c – Conditions of payment

Credit packs and VIP dating memberships are paid in advance. A male member cannot contact a female member without purchasing one of the options above, unless he has received free credits or a complimentary membership, through a promotional code for instance.

Payment are made by credit card only. The following cards are accepted:

  • Visa
  • Mastercard
  • American Express
  • Discover Network
  • JCB Cards
  • Dinner Club International

Once a payment has been made and successfully processed, credits will automatically appear on the member’s Checkhimout.com online dating account.

All payments are final. No refund is possible under any circumstances, except for illegal use of a means of payment. Fraudulent use of a means of payment is punishable by law.

d – Renewal and cancellations

Renewal:

Credit packs – Once all the credits of a pack are consumed, there will be no automatic renewal of the purchase. The subscriber can choose to buy a new credit pack through his Checkhimout.com online dating account.

VIP Membership – A membership gets renewed for another term at the end of each 3-month subscription, indefinitely. This renewal can be cancelled at any time before the last 3 days of the term of a membership by making a written request to Checkhimout.com at billing@checkhimout.com.

Unsubscribing:

If You unsubscribe from Checkhimout.com, You will not be reimbursed of unused credits or of the full or partial value of Your unfinished online dating membership. Although Your profile will be cleared from the Checkhimout.com member database, Your credits will be kept indefinitely for recovering if You wish to reactivate Your membership. This does not apply for the VIP dating membership, which necessarily resumes at the end of the 3 month term.

d – Privacy

Subscription to Checkhimout.com is a voluntary action. A Member voluntarily submits and provides content to Checkhimout.com.

By submitting any content (including without limitation, Your photograph) to our Service, You authorize Checkhimout.com to publish pictures, information, or any data that You want to be posted on checkhimout.com. In doing so, You:

  • warrant that the content, including Your photograph, is posted by You and that You are the exclusive author of the content, including Your photograph, and use of Your content by us will not infringe or violate the rights of any third party.
  • assign and grant forever to Checkhimout.com, its licensees, affiliates and successors, a perpetual, worldwide, non-exclusive, royalty-free right and license to use, reproduce, display, and modify such content or incorporate into other works such content, and to grant and to authorize sub-licenses of the foregoing, and waive absolutely any and all moral rights to be identified as the author of the content, including Your photograph, and any similar rights in any jurisdiction in the world.

a – Use of personal information – Privacy Policy

What type of information does Checkhimout.com collect?

When using our online dating service, members are encouraged to set up a personal profile including personal photos. They may then conduct searches for members of the opposite sex, send gifts to members, exchange private and instant messages with potential dates, install applications and otherwise transmit information through various channels. The information resulting from these activities is collected and stored by Checkhimout.com.

How does Checkhimout.com use personal information?

We collect the information resulting from Checkhimout.com’s website activity so that we may provide our members with the best possible dating experience and offer them an array of personalized features. For instance, the personal geo-demographic information provided by a member when creating his or her free profile lets them appear in their potential dates’ search results.

Does Checkhimout.com share personal information?

We will securely save members’ personal information (email address), and demographic data (city, age, gender) on our servers. Checkhimout.com may share only general demographic data not associated with any particular users' profile with third parties.

How does Checkhimout.com communicate with its members?

After registration to our service, we will send subscribers a welcoming confirmation email based upon the personally identifiable information they provided, in order to verify their username and password.

We will also communicate with members in response to their direct inquiries and in order to manage their personal account, when necessary. Such personal communication will be conducted by email or telephone, in accordance with a member’s stated wishes.

By providing any personal information to Checkhimout.com, all of the website’s members, including, without limitation, international members, fully understand and unambiguously consent to this privacy policy.

Cookies are used to identify the Member during the surfing of the website. The Member can refuse the installation of cookies by the intermediate of his Internet provider (please read the users manual of Your provider).

c – Ownership Rights

  • WE ARE NOT RESPONSIBLE FOR ANY PROBLEMS OR TECHNICAL MALFUNCTION OF ANY TELEPHONE NETWORK OR LINES, COMPUTER ONLINE SYSTEMS, SERVERS OR PROVIDERS, COMPUTER EQUIPMENT, SOFTWARE, FAILURE OF EMAIL/CHAT OR PLAYERS ON ACCOUNT OF TECHNICAL PROBLEMS OR TRAFFIC CONGESTION ON THE INTERNET OR AT ANY WEBSITE OR COMBINATION THEREOF, INCLUDING INJURY OR DAMAGE TO USERS OR TO ANY OTHER PERSON' S COMPUTER RELATED TO OR RESULTING FROM PARTICIPATING OR DOWNLOADING MATERIALS IN CONNECTION WITH THE SITE AND/OR IN CONNECTION WITH THE SERVICE.
